Eskom complies with court order, releases legacy energy contracts

Eskom has released historical energy and fuel supply contracts following a Supreme Court of Appeal ruling under the Promotion of Access to Information Act.

The disclosure includes four categories:

  • Independent power producer contracts feeding the grid
  • Coal supply, transport, and distribution agreements
  • Diesel procurement contracts
  • Electricity export agreements to neighbouring countries

This follows a legal order requiring disclosure of contracts active as of July 2022.

Alongside the release, Eskom confirmed an ongoing forensic investigation into a diesel procurement and storage tender. The probe is focused on possible irregularities during emergency operations in 2025.

A final report is expected in mid-June 2026. Eskom has indicated it will pursue civil or criminal action where evidence supports it.

Separately, Eskom has reinstated full-scale procurement assurance checks for high-value contracts above R500 million. These had been scaled down in 2022 and are now back in place after identified governance gaps.

The utility says the goal is direct: tighter control over procurement decisions and reduced exposure to irregular contracting.
